How to get the Universal Credit health element

1. Tell the DWP about your health

If you already get Universal Credit, report a change of circumstances in your online account, or tell your work coach. If you are claiming for the first time, say you have a health condition or disability when you apply.

2. Send a fit note

If you have been unwell for more than 7 days, you need a fit note. Upload it to your journal or give it to your work coach. Keep getting new fit notes until you have your decision. The 3 month waiting period usually starts from the date you give the DWP medical evidence.

3. Fill in the UC50 form

The DWP sends you a UC50 form, "Capability for work questionnaire". You usually have 4 weeks to send it back. Describe your worst days as well as your better ones, and include letters from your GP, consultant or care team.

4. Have a Work Capability Assessment

Most people then have an assessment with a health professional, by phone, video or face to face. Read the Work Capability Assessment explained for what to expect.

If you are terminally ill, tell the DWP and ask your doctor or nurse for an SR1 form. You will not need an assessment and there is no waiting period.

5. Get your decision

• LCWRA: you get the health element. Most new claimants get the lower rate. You get the higher rate if you meet the severe conditions criteria or are terminally ill.
• LCW: no extra money for most people, but fewer work rules and a work allowance.
• Fit for work: no health element.

If you disagree, ask for a mandatory reconsideration within one month, then you can appeal to a tribunal.

If you have paid enough National Insurance, you may be able to get New Style ESA too. One Work Capability Assessment is used for both.
